By purchasing or downloading any audio asset from Defy Tracks, you agree to the terms outlined in this agreement.

1. Overview

This website (defytracks.com) is owned and operated by Benjamin Davidson, doing business as Defy Tracks (“we,” “us,” or “our”), located in Charlotte, North Carolina, USA. These Terms of Service govern your use of our website and any purchases made through our store.

2. Products

Defy Tracks provides digital audio assets, including music packs and sound effects packs, designed for use in games, apps, and interactive media. All products are delivered digitally via download

3. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle handles all customer service inquiries and returns. By placing an order, you agree to Paddle’s Terms of Use and Privacy Policy in addition to these terms.

4. License

All purchases are governed by the Defy Tracks End User License Agreement (EULA), which is incorporated into these terms by reference. You are granted a non-exclusive license to use the assets according to the terms of the EULA. Unauthorized reproduction, sub-licensing, or distribution of the raw audio files is strictly prohibited.

5. Payments & Taxes

All prices are listed in USD. As the Merchant of Record, Paddle is responsible for the collection of applicable sales tax or VAT based on your location at the time of purchase.

6. Refunds

We offer a 14-day refund window from the date of purchase. Please note that refunds are not available once a download has been initiated. For full details, see our Refund Policy.

7. Intellectual Property

All audio assets, artwork, and website content are the intellectual property of Benjamin Davidson / Defy Tracks. Your purchase grants you a usage license but does not transfer ownership of the underlying copyrights.

8. Disclaimer & Liability

All products are provided “as-is” without warranty of any kind. Defy Tracks is not liable for any damages, including data loss or project delays, arising from the use of our products.

9. Changes to Terms

We reserve the right to update these terms at any time. Continued use of the site constitutes acceptance of any changes.
